أعادت التعديلات الجديدة على نظام المنافسات والمشتريات الحكومية 1448 رسم عدد واسع من الإجراءات المالية والتعاقدية للجهات الحكومية، عبر 83 تعديلاً شملت التخطيط للمشتريات، وأساليب المنافسة، والشراء المباشر، وفتح وفحص العروض، والصلاحيات، والضمانات، وأوامر التغيير، والغرامات، وإنهاء العقود، والتظلمات.
سرعة الإجراءات
وتكشف وثيقة وزارة المالية الخاصة التي حصلت «عكاظ» على نسخة منها بـ«أبرز التعديلات على نظام المنافسات والمشتريات الحكومية 1448» توجهاً لرفع سرعة الإجراءات الحكومية ومنح الجهات صلاحيات أوسع، بالتوازي مع تعزيز التوثيق والرقابة والمحتوى المحلي وحماية حقوق المتعاقدين.
ومن أبرز التغييرات المتعلقة بالصلاحيات رفع حد تفويض رئيس الجهة الحكومية لمن يراه للبت في الإجراءات واتخاذ القرارات من 10 ملايين ريال إلى 50 مليون ريال، إلى جانب إتاحة تفويض صلاحية توقيع العقود والوثائق التي كانت تتطلب توقيع رئيس الجهة الحكومية إلى من يراه مناسباً من مسؤولي الجهة.
الشراء المباشر
ومن أبرز التحولات المالية رفع الحد الأعلى لاستخدام الشراء المباشر من 100 ألف ريال إلى مليون ريال، مع اشتراط أن توضح الجهة الحكومية أسباب استخدام هذا الأسلوب وتوثقها بما لا يخل بمبادئ المنافسة وكفاءة الإنفاق. كما توسعت حالات الشراء المباشر لتشمل البحث والتطوير والابتكار، وممارسي المهن الحرة، والرخص والبرامج والمواقع الإلكترونية، والمجلات العلمية، وحجز مساحات المعارض والمؤتمرات، وتدريب موظفي الجهات الحكومية.
وفي مقابل توسيع نطاق الشراء المباشر، ألغت التعديلات إمكانية استخدام المنافسة المحدودة لمجرد أن قيمة الأعمال أو المشتريات لا تتجاوز 500 ألف ريال، وألزمت الجهة الحكومية بتوضيح أسباب اللجوء إلى المنافسة المحدودة وبيان عدم ملاءمة المنافسة العامة، بما يضع مبرر اختيار أسلوب المنافسة ضمن متطلبات القرار الحكومي.
The new amendments to the Government Procurement and Competition System 1448 have drawn a wide range of financial and contractual procedures for government entities, through 83 amendments that included planning for procurement, methods of competition, direct purchasing, opening and examining bids, authorities, guarantees, change orders, penalties, contract termination, and grievances.
Speed of Procedures
The document from the Ministry of Finance, which "Okaz" obtained a copy of titled "Key Amendments to the Government Procurement and Competition System 1448," reveals a trend to increase the speed of government procedures and grant entities broader authorities, alongside enhancing documentation, oversight, local content, and protecting the rights of contractors.
Among the most notable changes related to authorities is the increase in the delegation limit for the head of the government entity to appoint someone to decide on procedures and make decisions from 10 million riyals to 50 million riyals, in addition to allowing the delegation of the authority to sign contracts and documents that previously required the signature of the head of the government entity to someone deemed appropriate from the officials of the entity.
Direct Purchasing
Among the most significant financial transformations is the increase in the maximum limit for using direct purchasing from 100,000 riyals to 1 million riyals, with the condition that the government entity clarifies the reasons for using this method and documents them in a manner that does not undermine the principles of competition and spending efficiency. The cases for direct purchasing have also expanded to include research, development, and innovation, practitioners of freelance professions, licenses, programs, and websites, scientific journals, booking exhibition and conference spaces, and training employees of government entities.
In contrast to the expansion of the scope of direct purchasing, the amendments eliminated the possibility of using limited competition merely because the value of the works or purchases does not exceed 500,000 riyals, and obligated the government entity to clarify the reasons for resorting to limited competition and to state the unsuitability of public competition, thus placing the justification for choosing the competition method among the requirements of the government decision.
