The Ministry of Municipalities and Housing has adopted regulations and procedures for organizing real estate transactions on lands subject to white land fees. The rules include an organization for cases of restricting the transfer of ownership according to specific conditions and procedures, which contributes to organizing real estate transactions, taking into account the needs of owners and developers, and supporting the continuity of development and real estate investment projects.
The ministry clarified that the adoption of these regulations comes in implementation of a Cabinet decision that stipulates that real estate transactions transferring ownership of lands subject to white land fees will not be documented unless the due fees are verified as paid, taking into account cases that require special organization for transactions.
The municipalities indicated that the cases include offering the entire land as an in-kind contribution to the capital of a real estate investment fund, dividing the inheritance among heirs, and selling the land to a buyer who will develop or build on it during the additional period granted to the taxpayer according to the specified conditions, in addition to subdividing lands subject to the fee or merging them among the owners themselves for the purpose of development, and ownership transfer transactions based on judicial rulings.
It added that the cases include transactions executed within approved projects for sale and leasing on the map, transactions in which the state is a party, or those arising from expropriation for public benefit and temporary possession of properties.
The ministry pointed out that documenting transactions in these cases requires completing the regulatory procedures, while continuing to comply with the payment of due fees according to the specified regulations, emphasizing that these cases do not represent an exemption from fees, but rather regulatory pathways that allow for the documentation of specific transactions according to their regulatory requirements.
