أعلنت هيئة النزاهة الاتحادية اليوم (الاثنين) صدور حكم بالسجن لمدة سبع سنوات بحق المدير العام لشركة توزيع كهرباء الوسط في وزارة الكهرباء؛ عن «جريمة الكسب غير المشروع»، إضافة إلى إلزامه برد مبلغ 25.7 مليار دينار يمثل قيمة الكسب غير المشروع والغرامة المالية التي تعادلها.
وقالت الهيئة في بيان إن محكمة جنايات مكافحة الفساد المركزية أصدرت حكماً بالسجن لمدة سبع سنوات بحق المدان علاء سمير راشد، المدير العام لشركة توزيع كهرباء الوسط في وزارة الكهرباء، استناداً إلى أحكام المادة 19/ثانياً من قانون هيئة النزاهة والكسب غير المشروع رقم 30 لسنة 2011 المعدل. وأضافت أن المحكمة قررت إلزام المدان برد قيمة الكسب غير المشروع البالغة 5,524,135,000 خمسة مليارات وخمسمائة وأربعة وعشرين مليون دينار عراقي، و5,538,593 خمسة ملايين وخمسمائة وثمانية وثلاثين ألف دولار أمريكي، إضافة إلى فرض غرامة مالية عليه تعادل قيمة الكسب غير المشروع، وفقاً لأحكام المادة 19/رابعاً من قانون الهيئة. وتابعت الهيئة أن قرار الحكم تضمن تأييد الحجز الواقع على الأموال المنقولة وغير المنقولة للمدان، مع إعطاء الحق لهيئة النزاهة الاتحادية بالمطالبة بالتعويض عن الأضرار، بعد اكتساب قرار الحكم الدرجة القطعية.
The Federal Integrity Commission announced today (Monday) the issuance of a seven-year prison sentence against the Director General of the Middle Electricity Distribution Company in the Ministry of Electricity for "the crime of illicit gain," in addition to obligating him to repay an amount of 25.7 billion dinars representing the value of the illicit gain and the equivalent financial penalty.
The Commission stated in a statement that the Central Anti-Corruption Criminal Court issued a seven-year prison sentence against the convicted Alaa Samir Rashid, the Director General of the Middle Electricity Distribution Company in the Ministry of Electricity, based on the provisions of Article 19/Second of the amended Integrity and Illicit Gain Law No. 30 of 2011. It added that the court decided to obligate the convicted individual to repay the value of the illicit gain amounting to 5,524,135,000 five billion and five hundred and twenty-four million Iraqi dinars, and 5,538,593 five million and five hundred and thirty-eight thousand US dollars, in addition to imposing a financial penalty equivalent to the value of the illicit gain, according to the provisions of Article 19/Fourth of the law. The Commission continued that the judgment included upholding the seizure of the movable and immovable assets of the convicted individual, granting the Federal Integrity Commission the right to claim compensation for damages after the judgment becomes final.
