حدد القضاء المصري جلسة 6 سبتمبر 2026 لحضور قائد منتخب مصر ولاعب نادي طرابزون سبور التركي محمد صلاح بشخصه أمام المحكمة، لأداء اليمين الحاسمة في دعوى مدنية تتعلق بمطالبة بأتعاب عن أعمال قانونية وإدارية واستشارات قال محام إنه قدمها لصالح اللاعب خلال سنوات سابقة.
وحددت الدائرة المدنية المختصة بمحكمة القاهرة الجديدة الابتدائية موعد الجلسة في الدعوى رقم 7826 لسنة 2025 مدني كلي، المقامة من المحامي عمرو فرج الله مرسي عبد التواب، الذي يطالب بإلزام محمد صلاح بسداد مستحقات مالية قال إنها تمثل أتعاباً عن أعمال قانونية وإدارية واستشارات وملفات قضائية باشرها لصالحه.
وألزمت المحكمة اللاعب بأداء يمين حاسمة تتعلق بنفي قيام المحامي بالأعمال الواردة في صحيفة الدعوى، وكذلك نفي وجود مبالغ مالية أو أتعاب مستحقة له عن تلك الأعمال.
ونبهت المحكمة إلى أن عدم حضور محمد صلاح لأداء اليمين أو امتناعه عن أدائها من دون مسوغ قانوني قد يترتب عليه اعتباره ناكلاً عنها، وما يترتب على ذلك من آثار قانونية وفقاً للقواعد المنظمة لليمين الحاسمة في الدعاوى المدنية.
وتعود وقائع النزاع إلى دعوى أقامها المحامي في سبتمبر 2025، طالب فيها بإلزام اللاعب بسداد قيمة أتعاب قال إنها مستحقة له مقابل أعمال قانونية وإدارية واستشارات وملفات قضائية تولى مباشرتها لصالحه، إلى جانب المطالبة بتعويض عن أضرار مادية ومعنوية قال إنها لحقت به نتيجة عدم حصوله على مستحقاته.
كما تضمنت الدعوى مطالبات بتعويض عن أضرار قال المدعي إنها مست بمكانته المهنية وسمعته كمحام، مع ترك تقدير قيمة التعويض للمحكمة، فضلاً عن المصروفات وأتعاب المحاماة.
واستند المحامي، بحسب المستندات المقدمة في القضية، إلى توكيل رسمي عام في القضايا صدر عام 2012، وقال إنه منحه صلاحية مباشرة الإجراءات والأعمال القانونية المتعلقة بمحمد صلاح، مشيراً إلى أن التوكيل ظل قائماً حتى أغسطس 2025، عندما أُخطر بتنحيه عن تمثيل اللاعب.
وفي المقابل، يدور جوهر النزاع حول مدى قيام المحامي بالأعمال التي يطالب بأتعاب عنها، وما إذا كانت هناك مستحقات مالية مترتبة عليها، وهي الوقائع التي طلب المدعي حسمها من خلال توجيه اليمين الحاسمة إلى اللاعب.
واليمين الحاسمة وسيلة قانونية في المنازعات المدنية يوجهها أحد أطراف الدعوى إلى الطرف الآخر للاحتكام إلى ذمته بشأن واقعة محددة محل خلاف، ويترتب على حلفها أو الامتناع عنها آثار قانونية تختلف بحسب ظروف الدعوى والواقعة التي انصبت عليها اليمين.
وقررت المحكمة إرجاء الفصل في المصروفات ومقابل أتعاب المحاماة إلى حين حسم النزاع، فيما لا تمثل الدعوى، في هذه المرحلة، حكماً نهائياً بثبوت مديونية على محمد صلاح، وإنما نزاعاً مدنياً لا يزال منظوراً أمام القضاء.
The Egyptian judiciary has set a session for September 6, 2026, for the captain of the Egyptian national team and player of the Turkish club Trabzonspor, Mohamed Salah, to personally appear before the court to take a decisive oath in a civil lawsuit concerning a claim for fees for legal, administrative, and consulting work that a lawyer said he provided for the player over previous years.
The competent civil circuit of the New Cairo Primary Court has scheduled the session in case number 7826 for the year 2025, a general civil case filed by lawyer Amr Farag Allah Morsi Abdel Tawab, who is demanding that Mohamed Salah be obligated to pay financial dues that he claims represent fees for legal, administrative, and consulting work and court files he handled on his behalf.
The court has required the player to take a decisive oath regarding the denial of the lawyer's performance of the work mentioned in the lawsuit, as well as the denial of the existence of any financial amounts or fees due to him for that work.
The court warned that Mohamed Salah's failure to appear to take the oath or his refusal to do so without a legal justification may result in him being considered as having abandoned it, with the legal consequences that follow according to the rules governing the decisive oath in civil lawsuits.
The facts of the dispute date back to a lawsuit filed by the lawyer in September 2025, in which he demanded that the player be obligated to pay the value of fees he claimed were due to him for legal, administrative, and consulting work and court files he undertook on his behalf, in addition to claiming compensation for material and moral damages he said he suffered due to not receiving his dues.
The lawsuit also included claims for compensation for damages that the plaintiff said affected his professional standing and reputation as a lawyer, leaving the assessment of the compensation amount to the court, as well as the expenses and attorney's fees.
The lawyer, according to the documents submitted in the case, relied on a general power of attorney in legal matters issued in 2012, stating that it granted him the authority to undertake the legal procedures and work related to Mohamed Salah, indicating that the power of attorney remained valid until August 2025, when he was notified of his resignation from representing the player.
In contrast, the essence of the dispute revolves around whether the lawyer performed the work for which he is claiming fees and whether there are any financial dues resulting from it, which are the facts the plaintiff requested to resolve by directing the decisive oath to the player.
The decisive oath is a legal means in civil disputes directed by one party to the other to refer to his conscience regarding a specific fact in dispute, and taking it or refusing to do so has legal consequences that vary according to the circumstances of the case and the fact to which the oath pertains.
The court decided to postpone the ruling on expenses and attorney's fees until the dispute is resolved, while the lawsuit, at this stage, does not represent a final judgment confirming a debt on Mohamed Salah, but rather a civil dispute still pending before the judiciary.
